SUING FOR FREEDOM IN KENTUCKY

This is the website for books by Arnold Taylor, telling the true stories of Kentucky slaves who sued for their freedom, sometimes successfully, sometimes not. It is not well known that slaves had the right to sue for freedom. Yet, it is true; Kentucky law gave them that privilege, although the legal bases on which the slave could sue were quite limited.


I have written two books about lawsuits filed for their freedom by Kentucky slaves, based on information taken from case files in the Kentucky State Archives in Frankfort, Kentucky. The first book was Rose, a Woman of Colour. A Slave's Struggle for Freedom in the Courts of Kentucky. ($13.95, pp.130), Rose, later Rose Gatliff, filed suit for her family's freedom in Whitley County, Kentucky in 1833; after four trials and one appeal, she was finally successful in 1852. One witness testified that she was "the best lawyer the Negroes had."

After the family was declared free, they remained in Rockcastle County, Kentucky for a time. Rose died before the 1860 Census, and by 1880 many of the family were living in Chillicothe, Ohio, and by 1900 several were in Cincinnati, working in the railroad industry. Even today, descendents of Rose live in the Columbus, Chillicothe and Dayton areas.




Rose's suit was partly based on the fact that she was very white, which could be reason enough for a judge or jury to declare a plaintiff free, but also on her claim that she was born in Virginia as the child of an Indian woman. Since native americans could not be enslaved in Virginia, except for a brief period of time in the late seventeenth century, a child of an Indian was free-born.

Some readers of Rose expressed surprise that slaves had any rights, much less the right to go to court and sue for their freedom. Since Rose's claim was based on two limited grounds, I decided to resume research at the Archives, to locate examples of other principles on which a slave could claim his freedom in the courts of Kentucky. My second book, Suing For Freedom in Kentucky ($15.95, pp.283), was the result.

Both books contain valuable resources for genealogists, with particular potential for African American genealogy. It is not always possible to identify specific former slaves, as their first names were so often similar, but as with Rose, whose family took the name of Gatliff, freed slaves often took their former masters' surnames as their own.

RECENT EVENTS

ON AUGUST 6TH, I HAD THE PLEASURE OF ATTENDING THE ANNUAL CONVENTION OF THE KENTUCKY GENEALOGICAL SOCIETY IN FRANKFORT, WHERE ELIZABETH SHOWN MILLS WAS THE PRINCIPAL SPEAKER. I ALSO HAD A TABLE FOR SALE OF THE BOOKS AND WAS GRATIFIED BY THE RESPONSE.

ON AUGUST 14TH, I WAS THE GUEST LECTURER AT THE BAKER HUNT FOUNDATION  SUMMER LECTURE SERIES, WHERE I SPOKE PRINCIPALLY ABOUT ROSE, A WOMAN OF COLOUR, BUT ALSO ABOUT THE NEW BOOK.

ON OCTOBER  7TH, I WAS THE SPEAKER AT A HYDE PARK METHODIST CHURCH DINNER GROUP. I SPOKE ON THE SUBJECT OF SLAVES' SUITS FOR FREEDOM IN KENTUCKY AND TOLD ROSE'S STORY PARTICULARLY.

ON JANUARY 21, 2012, I SPOKE TO THE SCOTT COUNTY, KENTUCKY GENEALOGICAL SOCIETY IN GEORGETOWN, KENTUCKY AND TOLD THE STORIES OF ROSE AND OTHER SLAVES WHO SUED FOR THEIR FREEDOM. THERE WAS A GOOD TURNOUT AND I WAS HAPPY WITH THE RESPONSE.

I WILL BE ATTENDING THE ANNUAL SEMINAR OF THE KY GENEALOGICAL SOCIETY IN AUGUST, AND PLAN TO DONATE FOUR OF MY BOOKS AS DOOR PRIZES. I AM CURRENTLY WORKING ON A PROJECT FOR KENTON COUNTY, KENTUCKY, THAT WILL LIST ALL NAMED SLAVES IN KENTON COUNTY FROM ITS FORMATION IN 1840 THROUGH ADOPTION OF THE 13TH AMENDMENT.
